Terms version 2026-09-03.3

These terms govern your access to and use of budget.repair, including its pages, forms, booking tools, quote requests, downloads, and other online features. Budget Repair LLC's separate Repair Terms of Service govern diagnostics, repairs, data services, parts, warranties, and Device pickup.

The short version

• The Site provides general information. Prices, timing, parts, availability, and results are not final until Budget Repair accepts them in a written estimate, work order, or other agreement.
• A form, message, booking, or quote request does not authorize repair work by itself.
• You may use the Site for lawful personal use or to evaluate doing business with us. You may not attack it, scrape it in violation of these terms, impersonate someone, send spam, or submit harmful or unlawful material.
• Our Privacy Policy explains how we handle personal information submitted through the Site.
• Most Site disputes must be handled individually in small claims court or binding arbitration. Section 19 explains that process and how to opt out of arbitration within 30 days.

The full terms below control. Nothing in these terms takes away a right or remedy that applicable law does not allow you to waive.

1. Scope and acceptance

"Budget Repair," "we," "us," and "our" mean Budget Repair LLC. "You" and "your" mean the person using the Site and any business or other entity that person is authorized to represent. "Site" means budget.repair and the online features Budget Repair operates through that domain.

By accessing or using the Site after having a reasonable chance to review these terms, you agree to them and to the policies they incorporate. If you do not agree, do not use the Site. You must be at least 18 years old to submit a binding request, create an account if we offer one, or accept an agreement through the Site. A minor may use a public informational page with permission and supervision from a parent or legal guardian.

Using the Site does not create a partnership, agency, employment, franchise, fiduciary, or joint-venture relationship. You may not speak for Budget Repair, make a promise in our name, or bind us to an agreement.

2. Related policies and transaction terms

Our Privacy Policy governs personal information handled through the Site. The Repair Terms of Service, an accepted estimate or work order, an invoice, any separately accepted diagnosis terms, and any signed project or business agreement govern the transaction they cover. If a specific transaction term conflicts with these terms, the specific term controls that transaction.

Website content does not change a manufacturer warranty, protection plan, software license, carrier agreement, payment-provider agreement, or another third party's terms.

3. Changes to the Site or these terms

We may change the Site, remove a feature, or update these terms. We will post each new version here. An update applies to Site use after it takes effect. It does not rewrite an earlier accepted repair order, sale, or signed project agreement unless that agreement or applicable law allows the change.

Your continued use after an update means you accept the updated Site terms. Check this page when you use the Site for a new transaction.

4. Accurate information, accounts, and authority

When you submit a form, request, booking, review, payment, or other information, you agree to provide information that is accurate, current, and complete. You must have authority to provide information about a Device, account, person, business, or property included in your submission. We may decline, pause, or cancel a request when information appears false, incomplete, unlawful, unsafe, or unauthorized.

If the Site offers an account, password, passcode, or secure link, you are responsible for keeping it confidential and for activity under it. Do not sell, transfer, share, or let an unauthorized person use access issued to you. Tell us promptly at techsupport@budget.repair if you believe someone used it without permission. We may require identity or authority checks, reset credentials, or restrict access to protect the Site, a customer, or Budget Repair.

5. Access, connection, and security

You are responsible for the equipment, software, internet service, and other connections needed to use the Site. We may restrict or withdraw some or all access for maintenance, security, capacity, legal compliance, misuse, or another business reason. The Site may be unavailable without notice.

You are responsible for people who use the Site through your device, account, or network. Do not assume a public page or email is a secure channel for passwords, payment-card numbers, health records, trade secrets, regulated data, or other highly sensitive information. Use a secure method we approve when the requested service needs such information.

6. Site information, service descriptions, and quotes

Site content is general information, not a complete description or guarantee. A page may describe a service, price, discount, part, product, turnaround time, appointment, warranty, or result that is unavailable for a specific Device or project. Photos may be illustrative. Typographical, technical, inventory, and pricing errors can occur. We may correct an error and decline or cancel a request based on incorrect Site information, subject to applicable law.

A website estimate, automated quote, phone quote, appointment time, or message is preliminary unless Budget Repair accepts it as final in writing. We confirm the Device, condition, scope, parts, price, timing, and service terms separately. Submitting a form or booking does not require us to accept work and does not authorize us to open, test, repair, or alter a Device.

Site content is not legal, financial, medical, cybersecurity, data-retention, or manufacturer-warranty advice. You must decide whether a service fits your needs and keep independent backups and security controls appropriate to your situation.

7. Permitted use and prohibited conduct

You may use the Site for lawful personal purposes and to evaluate or manage a legitimate relationship with Budget Repair. You may not use the Site to:

• break a law, violate another person's rights, evade a license or security control, or ask us to do so;
• impersonate Budget Repair, an employee, a customer, or another person, or misstate your identity, authority, affiliation, Device ownership, or payment authority;
• submit material that is fraudulent, defamatory, threatening, harassing, obscene, exploitative, invasive of privacy, infringing, or otherwise unlawful;
• send spam, chain messages, unauthorized advertising, or repeated automated form submissions;
• upload or transmit malware, ransomware, spyware, harmful code, corrupted files, or instructions designed to damage or disrupt a device, account, network, database, or service;
• probe, scan, test, bypass, defeat, or interfere with access controls, rate limits, authentication, availability, or security without our written permission;
• gain or attempt unauthorized access to the Site, its hosting, another user's information, or any connected system;
• overload, disable, damage, reverse engineer, decompile, alter, or interfere with the Site or its normal operation except where the law expressly permits the act despite this restriction;
• copy, harvest, monitor, or scrape Site content or personal information through an automated or manual process without written permission, except for a public search engine acting within our robots.txt rules or an accessibility tool used by a person to access the Site; or
• frame the Site, remove ownership notices, use our name or marks to mislead, or suggest an endorsement or relationship we did not approve.

8. Submissions, reviews, and feedback

The Site may let you submit text, photos, files, reviews, comments, or other material. You keep your ownership rights. You give Budget Repair a non-exclusive, worldwide, royalty-free license to host, copy, transmit, resize, display, and use the material only as reasonably needed to process your request, provide the feature you chose, document the transaction, protect the parties, and meet legal duties. A public review or comment may remain public and may be displayed with the name or profile you used. Our Privacy Policy applies to personal information.

You represent that you own the submission or have permission to provide it and that our permitted use will not violate a law, contract, privacy right, publicity right, intellectual-property right, or another person's rights. Do not submit someone else's private content, credentials, illegal material, or a Device image that exposes information you do not want processed.

If you send an idea or suggestion about the Site or our business without a separate confidentiality agreement, we may use it without payment or restriction. This does not give us ownership of your private Device data, repair files, or other material submitted only so we can perform a service.

9. Monitoring, enforcement, and termination

We may review a submission or Site activity when reasonably needed to operate the Site, investigate misuse, protect a person or system, respond to a rights complaint, enforce these terms, or follow the law. We do not promise to review every submission or stop every harmful act.

We may reject or remove material, limit a feature, block access, preserve records, contact a service provider, or refer conduct to law enforcement when we reasonably believe it is necessary. We may disclose information when a valid legal request requires it or when the law permits disclosure to address fraud, security, safety, or rights. These rights do not make Budget Repair responsible for user or third-party content we did not create.

10. Intellectual property

Budget Repair or its licensors own the Site's software, design, layout, compilation, original text, graphics, photos, videos, logos, and other protected content. We reserve every right not expressly granted. You may view the Site and print or save a reasonable copy for personal use or internal evaluation of our services. Keep all copyright, trademark, and ownership notices intact.

You may not reproduce, sell, publish, distribute, adapt, create a competing database from, or commercially exploit protected Site content without written permission. "Budget Repair," our logo, and related branding may be trademarks or trade dress. Other names and marks belong to their owners. Their appearance does not mean an owner sponsors, endorses, or is affiliated with Budget Repair.

11. Links and social features

You may link to a public Site page in a fair and lawful way that does not state or imply sponsorship, approval, or affiliation. Do not frame the Site, display it through an inline link, obscure its source, or link from unlawful or infringing content. We may withdraw linking permission and may disable a sharing feature or link.

If the Site provides a sharing or social feature, use it only as provided and for the content connected to it. The third-party platform's own terms also apply.

12. Copyright and rights complaints

If you believe Site material infringes your copyright, send a written notice to techsupport@budget.repair or the mailing address in section 21. Include: (1) your physical or electronic signature; (2) identification of the copyrighted work or a representative list of works; (3) identification and exact location of the material you want removed or disabled; (4) contact information reasonably sufficient for us to reach you; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and that you own the exclusive right or are authorized to act for its owner.

For another enforceable-right complaint, identify the right, the exact Site material and location, your contact information, the basis for the claim, and the action you request. We may request proof, remove or restrict material, notify the person who supplied it, or decline an incomplete or unsupported notice.

Do not knowingly make a false infringement claim. A false notice can harm Budget Repair or another person and may create legal liability.

13. Third-party websites and services

The Site may link to or use maps, reviews, social networks, scheduling tools, payment processors, analytics, video hosts, manufacturers, carriers, software vendors, or other third parties. They operate under their own terms and privacy practices. We do not control their content, availability, security, decisions, or data handling. A link or integration is provided for convenience and does not by itself mean endorsement or affiliation.

You use a third-party site or service at your own risk. Review its terms and privacy notice before providing information or completing a transaction. We may add, change, or remove a third-party link or integration without notice.

14. Privacy and electronic communications

Our Privacy Policy explains how we collect, use, retain, and disclose personal information. Cookies and similar tools may also be controlled through any privacy choices the Site makes available. These terms do not authorize the sale of Device data or private Device content.

When you give us an email address or phone number and ask us to respond, you agree that we may send transaction-related messages about your request, appointment, estimate, repair, payment, pickup, security, or these terms. Message and data rates may apply. Marketing messages require any separate consent the law requires. You may opt out of marketing without losing service messages needed for an active transaction. Consent to marketing is not a condition of purchase.

15. Promotions, surveys, and added features

A promotion, discount, survey, contest, payment tool, customer portal, or added feature may have separate rules. Those rules control that feature if they conflict with these terms. Participation is voluntary unless a transaction agreement states otherwise. An advertised offer is subject to its dates, eligibility, exclusions, inventory, and written conditions.

16. Site warranties and disclaimers

To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available." Budget Repair does not promise that the Site will be uninterrupted, secure, current, complete, accurate, compatible, or free of errors, malware, or harmful components. We do not promise that a defect will be corrected or that Site content will meet your needs.

You are responsible for reasonable device security, malware protection, data checks, and backups when using the internet or downloading material. We do not warrant third-party content or services. These disclaimers do not affect a written repair warranty or a warranty, right, or remedy that applicable law does not allow us to exclude.

17. Limits on Site liability

To the fullest extent permitted by law, under any theory of liability—including contract, warranty, tort, ordinary negligence, strict liability, or statute—Budget Repair and its owners, employees, contractors, and service providers are not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Site. This includes loss of use, time, revenue, profits, opportunity, goodwill, privacy, data, software, or business, and damage caused by service interruption, a third-party link, malicious code, unauthorized access, or reliance on Site content.

For a claim arising only from use of the Site, our total liability will not exceed the greater of the amount you paid Budget Repair specifically for the Site feature that caused the claim or $50. A purchase or repair claim is governed by the agreement for that transaction, including the Repair Terms of Service.

These limits do not apply to personal injury caused by Budget Repair, gross negligence, willful misconduct, or a liability or remedy that applicable law does not allow us to limit. Some jurisdictions do not permit certain exclusions, so a limit may not apply to you.

18. Claims caused by your conduct

To the extent permitted by law, you will defend, indemnify, and hold harmless Budget Repair and its owners, employees, contractors, service providers, successors, and assigns from a third-party claim and reasonable resulting cost, including reasonable attorney fees, caused by your unlawful use of the Site; a submission you had no right to provide; your breach of these terms; your negligence or willful misconduct; or your violation of law or another person's rights. This responsibility does not cover the portion of a claim caused by Budget Repair's own negligence, willful misconduct, or violation of law. We may control the defense of a covered claim while allowing you to participate with your own lawyer at your expense, and neither side may settle in a way that admits fault by or imposes a non-monetary duty on the other without that party's consent.

19. Individual dispute resolution, arbitration, and claim deadline

Please read this section carefully. It affects the right to have a court or jury decide a dispute and the right to take part in a class action.

Informal notice first

Before starting arbitration or a lawsuit other than an individual small claims case, the person making the claim must send a written notice to the other side. A notice to Budget Repair may be emailed to techsupport@budget.repair or mailed to the address in section 21. It must include the claimant's name and contact information, what happened, and the specific relief requested. Each side will allow 60 days after receipt for a good-faith effort to resolve the claim. A deadline is paused during that 60-day period if the law allows it.

Binding individual arbitration or small claims court

Except for a qualifying individual small claims case, a request for temporary relief to stop unauthorized access or misuse of intellectual property, or a claim that applicable law does not allow to be arbitrated, you and Budget Repair agree to resolve every dispute arising from or related to the Site, its content, a submission, a communication, or these terms through binding individual arbitration. The Federal Arbitration Act governs this agreement to arbitrate.

The American Arbitration Association will administer the case under its Consumer Arbitration Rules in effect when the case is filed. Those rules are available at adr.org/consumer or by calling 1-800-778-7879. The arbitrator may award the same individual remedies a court could award and must apply the controlling substantive law, including any non-waivable consumer remedy. A hearing may take place by phone, video, documents, or in the county where you live, as the rules permit. You will not pay more in arbitration fees than the amount the rules assign to a consumer. Budget Repair will pay the remaining administration and arbitrator fees when the rules require it. If the AAA cannot administer the case, the parties will try to agree on another recognized provider. If they cannot agree, a court may appoint an arbitrator under federal law.

This section does not stop either side from bringing an individual case in a court that qualifies as small claims court. It also does not stop you from reporting a concern to a federal, state, or local agency, and an agency may seek relief when the law allows.

Class action and jury-trial waiver

You and Budget Repair agree that each claim will be brought only in an individual capacity. Neither side will seek or take part in a class, collective, consolidated, mass, representative, or private-attorney-general case to the extent the law permits. You and Budget Repair also waive a jury trial for any dispute covered by this section. An arbitrator may award relief only to the individual party seeking it and only to the extent needed for that party's claim. A court, not an arbitrator, will decide whether this paragraph is enforceable.

Right to opt out within 30 days

You may opt out of the arbitration and class-action provisions by sending a signed notice within 30 days after your first use of this version of the Site terms or your first affirmative acceptance of them, whichever happens first. Email it to techsupport@budget.repair with the subject "Arbitration opt-out," or mail it to the address in section 21. Include your name and contact information and state that you opt out. Opting out will not affect your ability to use the Site or the rest of these terms.

Claim deadline

To the fullest extent permitted by law, a claim arising from the Site or these terms must be filed in small claims court or arbitration within one year after the claimant knew or reasonably should have known of the facts giving rise to it. This paragraph does not shorten a filing period that applicable law does not allow the parties to shorten.

If part of this section is unenforceable, the rest remains in effect to the greatest extent the law allows. If the prohibition on class or representative relief cannot be enforced for a specific claim, that claim must proceed in court rather than arbitration after any arbitrable individual claims are complete.

20. Governing law and general terms

Kansas law governs these terms without regard to conflict-of-law rules, except where federal law or another jurisdiction's non-waivable law applies. Any court case that may lawfully be limited to a venue must be filed in a court with jurisdiction in Douglas County, Kansas.

These terms and the policies they incorporate are the entire agreement about use of the Site. They do not replace the separate agreement for a repair, sale, or project. An oral statement does not change these terms unless an authorized Budget Repair representative confirms the change in writing.

Our failure to enforce a term once is not a waiver. If a court finds a term invalid or unenforceable, it will be enforced only to the lawful extent or removed, and the rest will remain in effect. Headings help with reading and do not change meaning. Terms that by their nature should survive, including ownership, disclaimers, liability limits, dispute terms, and responsibilities for third-party claims, survive the end of Site access.

You may not assign your rights or duties under these terms without our written consent. Budget Repair may assign these terms as part of a merger, reorganization, sale of the business or Site, or transfer to an affiliate or successor, subject to applicable law.
